GENERAL TERMS AND CONDITIONS OF SALE GUIDED TOURS FOR INDIVIDUALS ORGANISED BY THE Colmar and Region Tourist Office
APPLICATION

The general terms and conditions of sale described below detail the rights and obligations of the Colmar Tourist Office and its region (OT) and its customers in the context of the sale of guided tours organised by the Welcome service. Any purchase of an online tour on the Ingénie platform for individuals implies the customer's adherence to these general conditions of sale. The Tourist Office reserves the right to modify its general conditions of sale at any time. In this case, the conditions applicable will be those in force on the date of the reservation by the customer.

 ARTICLE 1- BOOKING CONDITIONS
For individuals, requests can be made directly on the online ticketing system via the website reservation.tourisme-colmar.com. They can also be made at the ticket office, subject to availability.
In order to be registered, the request must include the following information: surname, first name, telephone number and e-mail address of the customer, the number of visitors and the method of payment.

ARTICLE 2- DURATION OF GUIDED TOURS
2.1 The duration of the visits is mentioned on the website of the Tourist Office https://reservation.tourisme-colmar.com/visites-guidees-colmar.html as well as on the Ingénie interface put online by the Tourist Office.  
2.2 In case of delay of the individual Guided tours reserved for individuals always start on time. No refund will be due.

ARTICLE 3 - CAPACITY
Guided tours are planned for a maximum of 30 people per group (over 30 people, the group will be divided according to the principle of 1 lecturer for 30 people).
 The meeting point for each tour for individuals is set by the Tourist Office and communicated to the participant when he/she makes the reservation. The information is also specified on the web page dedicated to guided tours on the website.
ARTICLE 4 - TOURS
 Even when a route has been validated, in the event of unforeseen circumstances inherent in the health context, the operation of security or technical constraints or in the event of extreme weather conditions, the initial route of the tour may be modified on the same day, without this giving rise to any right to reimbursement or compensation from the Tourist Office.

ARTICLE 5 - MODIFICATION AND INTERRUPTION OF SERVICES
In the event that the customer interrupts the service, no refund will be made. Any guide is entitled to refuse or interrupt a service if the clients disrupt the smooth running of the visits.
ARTICLE 6- FINANCIAL CONDITIONS :
The prices of the service are those in force on the day of the reservation on the website of the Tourist Office: https://reservation.tourisme-colmar.com/visites-guidees-colmar.html . They include all taxes.
ARTICLE 7 - CANCELLATION AND REFUND CONDITIONS
Tickets for the guided tour are valid for the date of the reservation.
7.1 Cancellation by the client:
 All cancellations must be requested by email: info@tourisme-colmar.com
Once the online reservation has been made, a cancellation is possible until the day before the tour. No refunds will be made but a postponement is possible depending on the availability of other visits in the current month only.
If the customer does not show up, the amount of the payment is definitively lost.
7.2 Cancellation by the Tourist Office
 In the event of cancellation on the part of the Tourist Office (climatic events, works hindering free movement, etc.), the Tourist Office will inform the customer by email or telephone. The customer will be reimbursed within 30 days unless the customer agrees to postpone the service.
ARTICLE 8-PROTECTION OF PERSONAL DATA
Your data will only be processed and used insofar as this is necessary for the processing of your reservation request, the execution of the service and the invoicing of the latter. The banking data necessary for the payment on Ingénie are collected and processed by the latter.
ARTICLE 9- FORCE MAJEURE
 In the event of force majeure, the guide and the Tourist Office are not liable if events beyond their control occur during the visit. Force majeure is understood to mean any event outside the control of the parties that is both unforeseeable and insurmountable and that prevents either the client, the guide or the Tourism Office from fulfilling the obligations stipulated in the reservation. This will be the case in particular in the case of attacks, explosions, fires or exceptional weather conditions (storms, floods, snow or severe ice, etc.).
Strikes of the means of transport being announced in advance, they are not considered as an unforeseeable and insurmountable event. The client is responsible for finding out about the state of traffic in the Grand Est and for making the necessary arrangements. The Tourist Office and the guides reserve the right to cancel any reservation in the event of force majeure and to change the date. In the event of cancellation before or during the tour, the client will be offered a postponement free of charge within the year.
ARTICLE 10 - INSURANCE
 The client is responsible for all damage caused by himself or by any person for whom he is responsible. He is deemed to have taken out a civil liability insurance policy.
ARTICLE 11 - LITIGATION
 The applicable law is French law. This applies to both substantive and formal rules. Any disputes that may arise concerning the validity, interpretation, performance or non-performance, interruption or termination of the Contract shall be submitted to the competent courts of Colmar. The parties undertake beforehand and in good faith, to try to settle the dispute amicably
